Terms of Service

By using the Services, you accept these Terms. Any additional guidelines or policies we post within the Services are incorporated into these Terms by reference. Where the two conflict, explicit supplemental terms take precedence on the subject they cover.

• You must be at least 18, or the local age of majority if that is higher.
• You must be able, and have the legal capacity, to enter into a binding contract.
• You must show valid government-issued ID when asked. We may ask for a second form of ID for anti-fraud compliance.
• You agree to give accurate, current and complete information and to update it promptly when anything changes.
• We may, at our discretion, refuse or revoke access because of non-compliance or concerns about risk.

Lumen Star Modeling is an agency that coordinates and supports talent. We help with onboarding workflows, basic guidance, scheduling and general brand positioning. We do not act as the publisher of Model Content on Third-Party Platforms, and each of those platforms has its own policies. The Services carry no guarantee of bookings, earnings, audience size or promotional reach.

Where we give you access to an internal portal or dashboard:

• You must keep your login credentials safe. Any unauthorized access should be reported to us immediately.
• You may not share your login. Access by more than one person needs our written approval.
• We can suspend an account in order to investigate a suspected breach, fraud or policy violation.

• Make sure all Content meets applicable law, including age verification, consent and record-keeping requirements where they apply.
• Keep your performance environment safe and lawful, and do not encourage or depict illegal acts.
• Respect other people's intellectual property: no unlicensed music, videos, images or trademarks.
• Do not engage in deceptive or fraudulent conduct, including "chargeback" schemes or identity misuse.
• Where you collect subscriber or fan personal data directly, handle it in line with privacy laws.
• Tell us promptly about any platform strikes, warnings or legal notices that involve your performance activity.

Subject to our operational capacity and to continued compliance, we may:

• Help with general best-practice guidance, performance tips and structuring your schedule.
• Give limited administrative support, such as help setting up accounts on permitted Third-Party Platforms.
• Give feedback on branding or optimization, without any guarantee that it is comprehensive.
• Carry out an internal compliance review of identification documents, which are stored securely and kept only for as long as lawful purposes require.

We do not serve as legal counsel, a tax advisor or a professional financial advisor.

The following are strictly prohibited (these are examples, not a complete list):

• Any participation by, or depiction of, a person who is under 18 or cannot legally consent.
• Exploitation, human trafficking, coercion or any non-consensual act.
• Threats, intimidation, harassment, hate speech or inciting violence.
• Distributing other people's personal data ("doxxing") without lawful permission.
• Encouraging self-harm, or content that glorifies dangerous acts.
• Distributing narcotics unlawfully, or giving instructions for illegal activities.
• Material that infringes intellectual property or publicity rights.
• Scraping platform systems by automated means, or reverse engineering them, without consent.

We may cooperate with legitimate inquiries from law enforcement. Where the law or good-faith compliance obligations require it, we will remove suspect material or limit access to it.

Apart from Model Content, every element of the Services (design, code, graphics, trademarks, branding and text) is owned by or licensed to Lumen Star Modeling and is protected by international intellectual property laws. Without prior written consent, you must not copy, adapt or translate any of it, or create derivative works from it.

You keep ownership of the lawful Content you create. By submitting Content, or allowing us to access it, for support or promotional purposes, you grant us a worldwide, non-exclusive, royalty-free, transferable license (sublicensable to our infrastructure and service providers) to host, store, transcode, display, analyze (for example for quality or compliance review) and use that Content only for: (i) providing the Services; (ii) internal training and optimization; and (iii) neutral showcasing of the agency's capabilities, if you have explicitly consented. You may withdraw your consent to promotional display by written notice; operational caching or backup copies may persist for a reasonable period.

Each Third-Party Platform has its own terms, which you must review and follow independently. We bear no liability for outages, policy changes, moderation actions, monetization rules or loss of data on those platforms.

• We do not guarantee traffic, conversions or any particular level of earnings.
• When payouts arrive may depend on the payout cycles of Third-Party Platforms, clearance periods, minimum thresholds, fraud checks or compliance holds.
• Future payouts may be reduced or offset by chargebacks, refunds or platform penalties.
• You alone are responsible for declaring and paying all applicable taxes and social contributions, and for meeting any registration or withholding obligations in your jurisdiction.
• We may provide statements for information only; they do not constitute tax advice.

How we handle personal data is set out in our Privacy Policy. Where you process fan or viewer data on your own, you act as a separate controller (data steward) for that data and must follow the relevant laws, such as the GDPR and local rules on marketing consent.

Lumen Star Modeling respects intellectual property rights. If you think material on the Services infringes your rights, send a detailed notice that includes identification of the work, the URL or a description of the infringing material, your contact details, a good-faith statement and a declaration under penalty of perjury. Address it to: contact@lumenstarmodeling.com. We may ask for further verification. Making a misrepresentation may result in liability under applicable law.

We provide the Services "as is" and "as available", without warranties of any kind, whether express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, title, non-infringement, uptime, accuracy or continuous availability. We make no guarantee of earnings, audience growth or acceptance by any platform, nor that content will not be duplicated without authorization elsewhere on the Internet. Where a jurisdiction's implied warranties cannot be waived, they apply only to the minimum extent the law requires.

To the fullest extent the law permits, under no circumstances will Lumen Star Modeling or any of its officers, directors, employees, contractors or affiliates be liable for indirect, incidental, special, consequential, exemplary or punitive damages; lost profits; loss of goodwill; loss of data; or interruption of service, even if told that such damages were possible. Our aggregate liability for any claim arising out of or relating to these Terms or the Services is capped at EUR 100 (one hundred euros) or the total amount (if any) you paid us in the 3 months before the claim, whichever is greater. Some jurisdictions do not allow certain limitations; where that is the case, the limitations apply to the fullest extent the law allows.

You agree to defend, indemnify and hold harmless Lumen Star Modeling, together with its officers, directors, affiliates, employees and agents, from and against any claims, damages, obligations, losses, liabilities, costs, debts and expenses (reasonable attorneys' fees included) that arise from: (i) your use of the Services; (ii) your Content; (iii) a violation of these Terms; (iv) an infringement or violation of any third-party right; (v) a violation of the law.

We may suspend or end your access, with or without notice, if we reasonably believe you have violated these Terms or the law, or that you pose a risk. You may request closure by giving us written notice. Sections meant to survive termination continue to apply after it (for example Intellectual Property, License, Disclaimers, Limitation, Indemnity, Governing Law and Dispute Resolution). Operational data may remain in lawful backups for a limited retention period.

Except where mandatory local law requires otherwise, the laws of the Netherlands govern these Terms, without regard to conflict-of-law principles. The competent courts in Amsterdam have non-exclusive jurisdiction over any dispute that is not covered by an alternative resolution clause in these Terms.

Before starting formal proceedings, you agree to try to settle the matter informally first, by sending a detailed notice of the dispute to contact@lumenstarmodeling.com. If the dispute is still unresolved after 30 days, either party may pursue any permitted remedy. The parties may jointly agree to mediation or confidential arbitration. Nothing here stops either party from seeking injunctive or equitable relief over alleged misuse involving intellectual property or data security.

We may change these Terms at any time and may post material changes prominently. If you keep using the Services after a change, you accept it. If you object to a change, stop using the Services.

• If any provision is found to be invalid, the remaining provisions stay enforceable.
• Waiving a term once does not waive it for the future, and not enforcing a term does not amount to a waiver.
• You may not assign these Terms without prior written consent; we may assign them to an affiliate or a successor.
